<div dir="ltr"><div style="border-right:none;border-bottom:none;border-left:none;border-top:1pt solid rgb(225,225,225);padding:3pt 0cm 0cm"><p class="MsoNormal"><b>Oggetto:</b> Fondi inclusione, oltre 100 milioni di euro spesi male<u></u><u></u></p></div><p class="MsoNormal"><u></u> <u></u></p><div><p class="MsoNormal"><span style="font-size:12pt">Abbiamo raccolto diverse segnalazioni che ci riferiscono che molti comuni destinatari dei fondi per l'inclusione degli alunni con disabilità fisiche o sensoriali utilizzano gli stessi per erogare il servizio di assistenza per l’autonomia e la comunicazione mediante l’affidamento a enti convenzionati sulla base di <b>bandi che non rispettano la normativa vigente in materia di disturbo dello spettro autistico</b> ma neanche l'art 139 del decreto legislativo n. 112/98 e l'art. 13, comma 3, della legge 5 febbraio 1992, n. 104 in cui è espressamente prescritta la <b><u>specializzazione</u></b> del personale adibito al servizio di assistenza per l'autonomia e la comunicazione.</span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt"> </span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt">Specializzazione che è fondamentale perché gli allievi con autismo hanno difficoltà di comunicazione dovuta alla patologia organica (solitamente genetica) che gli impedisce sia un buon livello di autonomia sia la comunicazione in entrata e in uscita. È stata ampiamente dimostrata da decenni la falsità dell'ipotesi che questi allievi avessero la capacità di parlare e di ascoltare ma non ne avessero la volontà (come nel mutismo elettivo).</span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt"> </span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt">A differenza di quanto succede per la disabilità della vista e dell'udito, per quest'ultimi esiste anche la possibilità di scelta tra traduttori LIS, LIST oppure oralisti, i bandi non riportano i requisiti necessari a definire la specializzazione della figura professionale che deve assistere i bambini con autismo e pertanto gli enti accreditati, non avendo obblighi specifici, assegnano personale che non risponde ai dettami della Legge 104/92 e che non possiede la specializzazione necessaria a garantire la continuità assistenziale basata sull’Analisi Applicata del Comportamento; continuità garantita dalla Linea Guida n.21 del Ministero della Salute e dalle Linee di indirizzo approvate in Conferenza Unificata nel 2012 e confermate anche dall’aggiornamento del 10 maggio 2018, che la legge 134 del 2015 e l'art.60 dei LEA vigenti considerano diritto. Da qui deriva inoltre la mancanza di interesse da parte degli enti accreditati di provvedere alla formazione specifica iniziale e permanente dei lavoratori.</span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt"><br>Pertanto, non inserire questi riferimenti normativi “giustifica” gli enti accreditati a non dotarsi di personale specializzato in ABA e ne consegue che il servizio erogato non risponde ai dettami normativi ed in particolare non garantisce il diritto inviolabile all’educazione e all’istruzione dell'allievo con autismo.</span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt"> </span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt">Abbiamo interessato ministeri competenti, enti locali, ANAC e Corte dei conti ma ancora non ci è arrivata nessuna risposta.</span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initial;background-clip:initial"><span style="font-size:12pt"> </span><u></u><u></u></p><p class="MsoNormal" style="background-image:initial;background-position:initial;background-size:initial;background-repeat:initial;background-origin:initi
